Our company is one of the leading distributors of qualified hemp seeds for sowing. Since 2017 we have been supplying hemp seeds for sowing to farmers, growers and breeders throughout the country, conducting both in-store and online mail-order sales. We focus on both retail and wholesale sales.
We make every effort to ensure that product descriptions are correct; however, we do not guarantee that the published information is free of errors. At the same time, we inform you that any mistakes that occur cannot form the basis for any claims.

RULES FOR PROCESSING DOMESTIC ORDERS AND SHIPPING FEES
(information regarding international shipments can be found in the next part of these terms)
There are four ways to fulfill an order:
1* personal pickup
After prior payment for the ordered goods and receiving confirmation that the order is packed, personal pickup is possible in Marianów 3, 28-340 Sędziszów, or in Busko-Zdrój at Poprzeczna 4 Street (Monday to Friday, from 9:00 AM to 5:00 PM)
2* cash on delivery:
payment for the ordered products is handed over to the postal worker or courier upon receipt of the package. Applies to shipments up to 30 kg.
The consumer has the right to withdraw from the contract within 14 days of receiving the goods, provided the goods are returned undamaged.
If a refund becomes necessary for a transaction made by the Customer with a payment card, the seller will make the refund to the bank account assigned to the Customer's payment card.
In the case of card payment, the delivery time is counted from the moment of positive transaction authorization.

— Shipping —
The shipment is delivered to the customer within 3 business days from the moment the order is placed. In the event that seeds are not available in stock, the company reserves the right to deliver the seeds with a delay.
All packages are sent by courier or parcel locker!!!
Our company reserves the right to confirm the order.
Order confirmation means contacting the customer by phone or email to verify the authenticity of the order.
The cost of transporting the ordered goods is covered by the customer. The maximum weight of a shipment is 30 kg; packages weighing more than 30 kg will be sent under special conditions after consultation with our company.
— Personal pickup —
The order can be picked up in person in Busko-Zdrój at Poprzeczna 4 Street, or in Marianów 3, 28-340 Sędziszów, after arranging a pickup date in advance, thereby avoiding shipping charges. However, if you wish to save time, we ask that you place your order online in advance and select the "personal pickup" option, which will allow us to prepare the package for pickup at the agreed time. Personal pickup of ordered goods is possible from Monday to Friday, from 9:00 AM to 5:00 PM.
— Placing orders —
Placing an order in the Moderia.pl shop means accepting the sales rules resulting from these terms and obliges the Customer to comply with the rules contained therein.
Anyone who is over 18 years of age and has legal capacity may purchase goods.
When placing an order, Buyers are required to provide their details:
– first and last name,
– the address to which the package should be delivered (city, postal code, street, unit number),
– a phone number at which the order can be confirmed,
– e-mail address.
The fields in the order form labeled Username and Password are an individual identifier that the Customer assigns themselves.
The person placing the order consents to the processing of the above data by the seller for advertising and market research purposes, with the results intended to improve the quality of services provided by the seller.
In accordance with the "Personal Data Protection" Act, shop Customers have the right to view their data, correct it, and request that its use be discontinued.
Incorrectly completed order forms will not be processed.
Moderia PPHU reserves the right to refuse to fulfill orders that raise doubts.

The prices of individual product ranges, indicated in the commercial offer, are expressed in Polish zloty, include VAT, and are binding on both parties.
The appearance of goods listed in the commercial offer may, for technical reasons, slightly differ from the actual appearance of the goods.
The quantity of products offered in the shop is variable and is constantly updated, and Moderia PPHU reserves the right to withdraw certain products from sale.
In the event of a temporary lack of goods listed in the offer and covered by the order, Moderia PPHU will promptly inform the Buyer of this fact. In such a case, the Buyer may cancel the order, or, if the Buyer agrees, the goods will be replaced with another item or omitted from the order.
In the event of visible damage to the shipment, please check the delivered goods in the presence of the courier and have the courier draw up a complaint report. Please also notify the seller of this fact immediately.
The complaint report is the basis for requesting a refund from the seller for the damaged goods.
Acceptance of the shipment by the buyer without reservations, confirmed by their signature on the waybill, will be treated as delivery of an undamaged shipment.
In matters not regulated by these terms and conditions, the provisions of the Civil Code and the Act on the Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product of 31 March 2000 (Journal of Laws No. 22, item 271) shall apply.

RULES FOR PROCESSING INTERNATIONAL SHIPMENTS
— Shipments to EU countries —
We send shipments to European Union countries via a courier company.
The maximum weight of a single package is 30 kg – the price for such a shipment is PLN 99.00.
We send the package once the bank transfer for the purchased products has been credited to our account.
We do not send cash-on-delivery shipments abroad.
— International shipments outside the EU —
Please note that due to the limited ability to control the transport of international shipments outside the European Union, goods are sent at the buyer's risk, exclusively via Poczta Polska (Polish Post). When sending goods by post to the given address, we do not take responsibility for whether or when the shipment will reach the recipient.
Shipping prices are in accordance with the Poczta Polska price list.
The shipment, together with the shipping costs, must be paid for in advance by bank transfer.
We do not send cash-on-delivery shipments abroad.

PRODUCT DESCRIPTION AND COMPOSITION
We inform you that Moderia PPHU is not responsible for the germination rate of seeds or the feminization rate of plants, which primarily depend on the seed producers and are declared by them based on the Seed Qualification Certificate. Before purchasing goods from us, please review the description and composition provided by the manufacturer on the seed packaging. If the description of the goods in the shop does not match the description on the packaging, the customer has the right to return the purchased goods.
Please note that the seed label becomes invalid 12 months after the date of its issue.

INFORMATION ON EXERCISING THE RIGHT OF WITHDRAWAL FROM THE CONTRACT (RETURNS)
In accordance with current legal regulations, you have the right to withdraw from this contract within 14 days, provided that KOWR has not granted consent for entry into the Register of Industrial Hemp Producers. The goods must not have been used. The seed packaging must be in its original sealed condition, and the seed label (passport) must not be damaged!
The withdrawal period expires after 14 days from the day on which you took possession of the goods, or on which a third party other than the carrier and indicated by you took possession of the goods.
To exercise the right of withdrawal, you must inform us (Moderia PPHU Sylwester Wiekiera, Marianów 3, 28-340 Sędziszów, info@moderia.pl) of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post, fax, or e-mail).
You may use the model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send information regarding the exercise of your right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we will reimburse you all payments received from you, including the costs of delivery (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by us), without undue delay, and in any event no later than 14 days from the day on which we were informed of your decision to exercise the right of withdrawal from this contract. We will make the refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of this refund.
We may withhold the refund until we have received the goods back, or until you have supplied evidence of having sent the goods back, whichever is the earlier.
Please return or hand over the goods to us without undue delay, and in any event no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send the goods back before the 14-day period expires.
You will have to bear the direct cost of returning the goods.

INFORMATION REGARDING THE CONSUMER'S DECLARATION OF USE OF STATUTORY WARRANTY (COMPLAINTS)
In accordance with applicable regulations, we are liable to you under the terms set out in the Civil Code for physical and legal defects.
Upon discovering a defect, you have the right to:

submit a statement demanding a price reduction;

submit a statement of withdrawal from the contract, except when the defect is immaterial;

demand replacement of the item with one free from defects;

demand that the defect be remedied.
We will respond to your statement or demand within 14 days.
You are required to deliver the defective item at our expense to the address (Moderia PPHU Sylwester Wiekiera, Marianów 3, 28-340 Sędziszów, info@moderia.pl), and if delivering the item would be excessively difficult for you (e.g. due to the type of item or the manner of its installation), you are obliged to make the item available to us at the place where it is located.
The costs of replacement or repair are borne by Moderia PPHU Sylwester Wiekiera.
Our shop operates in accordance with the law and respects consumer rights, so the legal information found there will also apply to agreements with us.
